This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and WOODBINE CASINO WPASS LTD for the Woodbine Casino wPass software application ("the Software"), which includes the iOS application and any associated documentation or online services.
By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.
By using Woodbine Casino wPass, you acknowledge that you have read, understood, and agree to be bound by this EULA and our Privacy Policy. This EULA is effective from the moment you first install or use the Software and remains in effect until terminated in accordance with these terms.
WOODBINE CASINO WPASS LTD grants you a limited, non-exclusive, non-transferable, revocable licence to use the Software, subject to the terms of this EULA:
Use the Software
Install and use the Software on iOS devices you own or control, for the purpose of accessing your Woodbine Casino membership and related services.
Access the Service
Access and use the App's features — including digital pass, booking, rewards, and support — in accordance with this agreement.
Use Your Account
Authenticate with your Woodbine Casino membership credentials to access personalised features and your digital pass.

The Software is licensed, not sold. WOODBINE CASINO WPASS LTD retains all right, title, and interest in and to the Software, including all intellectual property rights. This EULA does not grant you any rights to trademarks or service marks of WOODBINE CASINO WPASS LTD or Woodbine Casino.

All software code, algorithms, designs, graphics, text, QR systems, booking logic, and other content in the application.
You Own
Your personal membership data and any user-generated content you create or submit through the Software.
Your use of the Software is also governed by our Privacy Policy. We collect and process your data as described in that policy. By using the Software, you consent to such collection and processing.

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WOODBINE CASINO WPASS LTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Software will be uninterrupted, error-free, or free of security vulnerabilities. QR code acceptance is subject to venue systems and conditions outside our control. Booking availability is subject to capacity and operational constraints.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WOODBINE CASINO WPASS LTD BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE.
This includes, but is not limited to, damages for loss of profits, loss of data, business interruption, inability to access the venue, or any other commercial damages or losses, even if we have been advised of the possibility of such damages.
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any term of this EULA. Upon termination:

WOODBINE CASINO WPASS LTD may provide updates, patches, or modifications to the Software from time to time. Some updates may be required for the Software to continue functioning properly and may be downloaded automatically via the App Store.
We reserve the right to modify this EULA at any time. We will notify you of material changes through the App or via email where possible. Continued use of the Software after any changes constitutes your acceptance of the modified EULA.
This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which WOODBINE CASINO WPASS LTD operates, without regard to its conflict of law provisions. Any disputes arising from this EULA shall be resolved through binding arbitration or the courts of the applicable jurisdiction, as determined by applicable law.
